Contract & Acceptance
These Terms & Conditions form the basis of the service relationship between Yash Data Recovery Services (“Yash Data Recovery”, “we”, “us”) and the person or organization submitting a device or requesting our services (“Client”, “you”). By submitting a device or approving recovery work, you agree to these terms.
Service Evaluation & Quotation
After receiving a storage device, we may perform an initial evaluation or diagnosis to determine the apparent condition of the device, the nature of the data-loss problem and the technical feasibility of recovery.
- An estimated recovery cost may be provided after evaluation.
- The quotation may depend on device condition, failure type, required tools, parts, clean-room work, complexity and other technical requirements.
- Recovery work beyond evaluation will normally begin only after the Client provides approval, where applicable.
- An estimate is not a guarantee of successful recovery or of the exact amount of data that can be recovered.
Authorization
The Client authorizes Yash Data Recovery Services and its authorized technicians to inspect, diagnose, test and perform reasonable recovery procedures on the submitted storage device for the purpose of attempting data recovery.
Where a procedure requires opening, modifying, repairing or otherwise working on a device, the Client acknowledges the technical risks associated with such work and authorizes us to proceed after the applicable approval.
Acknowledgment of Existing Device Conditions
The Client understands that a storage device may have pre-existing physical, electronic, firmware, logical or mechanical damage. Devices may also have been previously repaired, opened, dropped, exposed to moisture, subjected to software recovery attempts or otherwise altered before reaching us.
Yash Data Recovery Services cannot guarantee that a device will remain operational or that every file will be recoverable. In certain cases, recovery procedures can reveal or worsen underlying damage that was already present.
Authorization of Recovery Work
Where a quotation or approval is required, the recovery process will proceed after the Client confirms acceptance of the quoted terms. The scope of work may change if additional damage or technical requirements are discovered during the recovery process.
If additional charges or significant changes to the recovery approach become necessary, we may contact the Client for further approval before proceeding.
Data Verification
Recovered files should be checked by the Client before final delivery or closure of the case. The Client is responsible for verifying important files, folders, applications, documents, photographs, videos and other recovered content.
Because damaged storage media can contain corrupted, incomplete or partially recoverable files, the presence of a file or folder does not necessarily mean that every item is fully usable.
Confidentiality
Yash Data Recovery Services treats customer information and recovery-related data as confidential and limits access to authorized personnel or service providers who require access to perform the requested service.
Client data is not intentionally published, sold or disclosed to unrelated third parties. Disclosure may occur where required by law, legal process, regulatory requirements, or where reasonably necessary to provide the requested service or protect our rights and systems.
Ownership & Client Rights
The Client confirms that they own the submitted device and/or have the legal authority to request recovery of the data stored on it. The Client is responsible for ensuring that the data does not violate any applicable law, intellectual-property right, confidentiality obligation or third-party right.
Yash Data Recovery Services does not determine ownership of disputed data. If ownership or authorization is disputed, we may pause or refuse service until appropriate authorization is established.
Limitation of Liability
Data recovery is an inherently uncertain technical process. To the extent permitted by applicable law, Yash Data Recovery Services shall not be responsible for losses arising from circumstances beyond reasonable control or from the inherent condition of the submitted device.
- We do not guarantee recovery of a particular percentage, file, folder or type of data.
- We are not responsible for pre-existing damage or deterioration of a storage device.
- We are not responsible for loss caused by third-party courier or transportation services beyond our reasonable control.
- We are not responsible for business interruption, loss of profits, loss of opportunity or consequential losses arising from data loss.
- Where a client supplies a destination storage device for recovered data, the Client is responsible for the condition and capacity of that destination device.
Payment Terms
The Client agrees to pay the amount approved or otherwise agreed for the recovery service. Payment terms may vary depending on the type and complexity of the case.
- Recovered data may be released or delivered after the applicable payment has been received.
- Specialized cases may involve additional charges for parts, donor devices, clean-room procedures or other approved technical work.
- Taxes, courier charges or other third-party costs, where applicable, may be payable by the Client unless otherwise agreed.
Warranty & Manufacturer Terms
Data recovery procedures may affect manufacturer warranty coverage depending on the device and the work performed. The Client is responsible for determining whether manufacturer approval is required before recovery work is authorized.
Yash Data Recovery Services does not provide or extend the original manufacturer's warranty unless a separate written warranty is expressly provided for a particular service or component.
Expected Time Frame
Recovery timelines are estimates and may vary depending on device condition, failure type, availability of required parts or donor devices, workload, technical complexity and the nature of the recovery procedure.
A case may take longer than initially estimated when additional diagnosis, firmware work, hardware intervention, imaging, verification or specialized recovery procedures are required. Any timeline communicated by us should therefore be treated as an estimate rather than a guaranteed completion date.
Data Delivery & Retention
Recovered data may be delivered through a Client-provided storage device, another agreed storage medium, online transfer or another mutually agreed method, depending on the case.
Clients should promptly collect or securely copy recovered data after notification of completion. Yash Data Recovery Services may retain recovery-related copies only for a reasonable period required for verification, support or the agreed service process. The applicable retention period may vary by case and service arrangement.
Disclaimer
Yash Data Recovery Services uses professional tools, procedures and reasonable technical care, but no data recovery service can guarantee complete recovery in every situation. Results depend on the physical and logical condition of the media and the nature of the data loss.
These Terms & Conditions may be updated from time to time to reflect changes in our services, procedures, technology or applicable requirements. The version published on this page will apply from its stated update date, subject to applicable law.
